The liability burden by state seem to have hit a resistance point in ‘25, albeit at a high level. In our May Briefing we examine the liability burden (liability losses/GDP) at the state level and since 2000. There’s lots to be learned from this simple metric, which sheds light on how much of a state’s productive capacity is consumed by litigation.
